SEPARATION AGREEMENTS

When you are living with a person with whom you are in an intimate relationship, certain rights and obligations arise. When the relationship ends and you are living separate and apart, a separation agreement is a legal contract that sets out these rights and obligations in clear and comprehensible language.  

Creating a separation agreement is a cost-effective way to legally separate that does not involve expensive litigation.  It resolves all the legal issues prior to the issuance of a divorce order.  It requires a commitment from both sides to reach an agreement with the assistance of trustworthy legal advice.

A lawyer will help explain your obligations and entitlements following a separation and assist with the drafting of a separation agreement.  It is highly advisable that both sides to the dispute retain lawyers who will provide independent legal advice.  If one party has been pressured or tricked into signing a separation agreement, it might not hold up in a court of law, with costly consequences.
